Kayleigh's Law

    

A victims' protection should not end with their abuser's probation. A victims' protection should be indefinite. "Kayleigh’s Law" provides continued protection for victims and survivors of sexual and domestic abuse, regardless of the terms of their abuser's probation status. 

Information on Kayleigh's Law

  

  

"Kayleigh's Law" (SB1412) provides crime victims with the opportunity to petition the court to issue an injunction against harassment against the person who harmed them prior to the termination of the offender's probation. If issued, the injunction must be served prior to terminating probation and prohibits the offender from making any contact with the survivor.

Arizona is the first state to offer this protection to victims of violent crime. It is a critical step for survivors of sexual and domestic violence, who often experience ongoing harassment and stalking from assailants and abusive partners, even post-conviction.

The best way to ensure you are protected under this law is to opt in for post conviction notification. If you are listed as a victim in a case that is currently pending and would like to receive notifications about the case, please contact your local Victim Services Division.

Background Information on Kayleigh's Law

  

  

In February of 2020, Kayleigh had to face the man who sexually abused her as a young teen again in court. She had to appeal against his motion for early termination from his lifetime probation. Through the process, Kayleigh learned that when her perpetrator's probation ended, so did her protection. Based on the current Arizona laws at that time, there were no continued protections for victims. Together, with her local legislators, Kayleigh worked to draft a bill and create a new law. That law would provide victims and survivors of sexual and domestic abuse continued protection, regardless of the terms of their abuser’s probation status. In April of 2021, Governor Ducey signed SB1412, thus making Arizona the first state in the nation to offer the continued protection to victims and survivors of sexual and domestic abuse. In June of 2021, the Arizona State Senate Proclaimed SB1412 as "Kayleigh’s Law". 

Although it is incredible that this law has passed in her home state of Arizona, Kayleigh is on a mission to pass Kayleigh's law in all 50 states. It is not just the victims and survivors in Arizona that matter. Victims & survivors of sexual & domestic abuse everywhere matter, and they deserve this continued protection.

Wisconsin is the most recent state to draft "Kayleigh's Law"

  

 On July 21st, 2021 Wisconsin State Representative Barbara Dittrich proposed the bill for "Kayleigh's Law". Wisconsin is the second state in America to officially draft this bill. 

A Personal Message From Kayleigh

God has a purpose for our pain.

  

  When my abuser plead guilty and took a plea deal, it included lifetime probation. In 2020, I was informed that the man who abused me would likely have his “lifetime probation” terminated. I asked his probation officer, "what would provide direct protection for me from my abuser," because as it stood at that time, the only protection I had fell under the terms of his probation. I was informed that once his probation was lifted, my direct protection would also be gone. I could not wrap my head around the fact that it was an all or nothing scenario. A month later, and after 15 years, I had to do something that no victim should ever have to do; re-face their abuser in court and ask the judge to deny his appeal. In that moment, a fire was ignited within me. This was no longer just about me and my situation, it was about standing up and being a voice for victims and survivors everywhere! The law needed to change. God has a purpose for our pain, and fighting for this is mine. I contacted my local senator and she helped to introduce a piece of legislation in my home state of Arizona. The bill titled "SB1412" passed with complete bipartisan support. This issue was never about choosing a political side, this was about fighting for victims and survivors of sexual abuse and the continued protection they deserve! My eager heart is on fire to pursue this law to be passed throughout our nation. Victims and survivors of sexual and domestic abuse don’t just matter in Arizona, they matter everywhere! I will not stop fighting for this, I will not stop fighting for you, Because You Still Matter!
